Terms of Use
Effective October 13, 2026
These Terms of Use (“Terms”) govern your use of the BlkFin website (blkfinintel.com), our sign-up and application pages, and our merchant and agent portals (together, the “Services”), provided by BlkFin Merchant Intelligence, LLC (“BlkFin,” “we,” “us”). By using the Services, you agree to these Terms. If you use the Services for a business, you agree to them on that business’s behalf and confirm you have authority to do so.
Card processing is separate. Merchant processing services are provided under your merchant agreement with our processing partner and sponsor bank, which you review and sign during the application. If these Terms and your merchant agreement conflict on processing, your merchant agreement controls. Our Privacy Policy explains how we handle information.
1. The Services
The Services include information about our products, savings estimates and statement reviews, online applications, and portals that let merchants view reporting, take payments, send invoices and payment links, manage customers and users, and get support, and let agents manage leads, applications and their book of business. Features may change as we improve the Services, and some features are available only to accounts that have them enabled.
2. Estimates and statement reviews
Savings estimates, statement reviews and proposals are estimates for discussion only. They rely on the information you provide and on assumptions (such as card mix, interchange and transaction counts) that may differ from your actual processing. They are not an offer, a guarantee of savings, or a quote of final pricing. Your pricing is set in your approved application and merchant agreement. Statements you upload may be read with automated tools, including AI, and reviewed by our team.
3. Applications and accuracy
You agree that information you submit in a request or application is true, complete and yours (or your business’s) to provide, and that you will keep it up to date. Applications are subject to review and approval by our processing partners and sponsor banks, who may request more information or decline an application. Submitting an application does not create a merchant account until it is approved and your merchant agreement is in place. Typing your name and confirming on our signing page is your electronic signature.
4. Portal accounts and security
- Portal access is by invitation. Keep your login credentials and two-step verification device secure, and don’t share your account.
- Account owners control which team members have access and to which locations, and are responsible for activity by the users they invite.
- Tell us right away at support@blkfinintel.com if you suspect unauthorized access.
- We may suspend access to protect the Services, our users, or as required by our processing partners.
5. Taking payments through the portal
- Use the Virtual Terminal, invoices, payment links and recurring billing only for genuine sales of your own goods and services, with your customer’s authorization.
- For saved cards, recurring billing and payment plans, you are responsible for obtaining and keeping your customer’s authorization and honoring cancellation requests, as card network rules require.
- Refunds, voids, chargebacks and disputes are handled under your merchant agreement and card network rules.
6. QuickBooks Online add-ons
Optional paid add-ons connect the Services to your QuickBooks Online company: QuickBooks Invoicing ($29.95/month), QuickBooks Deposits ($14.95/month, included with Invoicing) and the Customer Portal ($49.95/month with Invoicing). Prices may change with 30 days’ notice.
- Billing: each plan starts with a 7-day free trial and is then billed monthly by BlkFin to the payment method you provide, until you cancel. Cancel any time; it ends at the close of the month you’ve paid for, and we don’t refund partial months. If a payment fails, we retry and may pause the add-on until it’s paid.
- What we do for you: when you connect, you authorize us to read your QuickBooks company, customers, invoices and account names, and, based on your settings, to send your invoices and reminders to your customers and to record payments and deposits in QuickBooks. You choose these settings and remain responsible for your books, your QuickBooks settings and the accuracy of what you invoice.
- Intuit: QuickBooks is provided by Intuit Inc. under its own terms. We’re not responsible for QuickBooks itself. Disconnect any time from the portal or from QuickBooks; records already created stay in QuickBooks.
7. Dual Pricing and surcharge programs
Dual Pricing and surcharge programs are configured on your account according to program rules we set with our processing partners. We provide the pricing calculations, receipt language and signage guidance for these programs. You are responsible for displaying the required signage, presenting prices accurately, and following card network rules and the laws of the states where you do business. Our guidance is not legal advice.
8. Acceptable use
You agree not to:
- use the Services for fraud, money laundering, prohibited or illegal businesses, or transactions you are not authorized to process;
- access accounts, locations or data you are not authorized to access, or try to get around permissions or security;
- probe, scan, disrupt or overload the Services, or submit automated or spam requests;
- upload malware, or content you don’t have the right to share; or
- copy, resell, reverse engineer or build a competing product from the Services.
9. Our content and your content
The Services, including the software, design, text and the BlkFin name and logo, belong to BlkFin and its licensors. We give you a limited, non-transferable right to use the Services for their intended purpose while these Terms apply.
You keep ownership of the information and materials you provide, such as your logo, invoice content and customer lists. You give us permission to use them to provide and support the Services. If you send us feedback or ideas, we may use them without obligation to you.
10. Third-party services
The Services rely on processing partners, sponsor banks, terminal manufacturers and other providers, and may link to third-party sites. Their services are governed by their own terms, and we are not responsible for third-party sites or services we do not control.
11. Disclaimers
We work hard to keep the Services accurate and available, but the Services are provided “as is” and “as available.” Reporting reflects information received from our processing partners and may be delayed or later corrected; your merchant statement and bank deposits are the official record. To the fullest extent allowed by law, we disclaim all warranties not expressly stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.
12. Limitation of liability
To the fullest extent allowed by law, BlkFin will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from your use of the Services. Our total liability for any claim relating to the Services under these Terms will not exceed the greater of $100 or the amount you paid BlkFin for the Services in the twelve months before the claim. This section does not limit liability that cannot be limited by law, and does not change the terms of your merchant agreement.
13. Indemnity
You agree to indemnify and hold BlkFin harmless from claims, losses and expenses (including reasonable attorneys’ fees) arising from your misuse of the Services, your violation of these Terms or the law, or information or content you provide.
14. Ending access
You may stop using the Services at any time. We may suspend or end access for violation of these Terms, at the request of our processing partners, or when your merchant or agent relationship ends. Sections that by their nature should continue (such as ownership, disclaimers, limitation of liability and indemnity) survive.
15. Changes and general terms
We may update these Terms as the Services change. We will post the new version here with a new effective date, and for significant changes we will give notice through the Services or by email. Continuing to use the Services after the change means you accept the updated Terms.
These Terms are governed by the laws of the State of Montana, without regard to its conflict-of-law rules. If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent.
